CL Finney Aviation, LLC DBA “AirCap Aviation” Financial Policy

 

At Air Cap Aviation we operate on a pay-as-you-fly basis. Unless other arrangements have been made, payment for services is due at the completion of each flight or training session.  Additionally, we will require that all previous training/rental invoices be fully paid prior to your next flight lesson or rental.  We accept the following methods of payment:

 

            Cash App (preferred)

            Personal Check

            Cash 

           

 

Occasionally a customer will advise us that they prefer to pay with a credit card.  Although we do not have the ability to “swipe” a card following a lesson, if you wish we can put your card information on file and then bill to your card following the lesson/rental.  Because of the increased administrative burden associated with accepting and processing cards we will charge a 5% “administrative fee” on such transactions.

Hold Harmless Agreement

The undersigned client, student and/or renter pilot understands that “AirCap Aviation” is a trade name used by CL Finney Aviation, LLC for the purpose of conducting flight training and aircraft rental services.

Furthermore, the undersigned student and/or renter pilot understands the inherent risk involved in aviation activities and freely chooses to incur this risk.

 

In that regard, the undersigned hereby voluntarily releases CL Finney Aviation, LLC its managers, employees, directors, and flight instructors of any and all claims, demands, rights and causes of action whatever kind and nature. Arising from and by reason of, any and all known and unknown, foreseen, and unforeseen, personal or property injuries or damages that have been or that may have been sustained in said undersigned in consequence to renting and/or negligence on behalf of CL Finney Aviation, LLC or it’s agents.

Policy and Procedures

 

1.0 General Information

  1. CL Finney Aviation, LLC DBA AirCap Aviation reserves the right to cancel any flight due to weather, technical problems of any other expected or unexpected situation.

  2. Failure to follow Local, State, FAR/AIM, POH or CL Finney Aviation, LLC operating procedures may result in removal or rental privileges.

  3. The Authorization to Solo may be withdrawn due to unsafe operations, or failure to follow operational specifications and requirements.

  4. Commercial operations in CL Finney Aviation, LLC aircraft is not allowed.

 

2.0 Scheduling Procedures

  1. CL Finney Aviation, LLC Rental Agreement, Policy and Procedures, and Statement of Release must be completed, and all the necessary documents provided, before scheduling an aircraft. Flight Schedule Pro is the preferred means to schedule aircraft and or instructors.

  2. No person may reserve an aircraft for solo flight unless 3 landings and takeoffs have been executed within the previous 90 days on the same class and category aircraft. The instructor’s Authorization to Solo will automatically expire 12 months after the last time the renter pilot has flown the specific make and model of CL Finney Aviation, LLC aircraft. Dual instruction is required to renew solo authorization.

  3. Only the renter pilot may make the aircraft reservation.

  4. The renter pilot should cancel a flight at least 30 minutes before scheduled departure time. No fee will be charged on the first occurrence. A $20 fee will be assessed to renter pilot 30 minutes after scheduled departure time. If IMC conditions exist, no notice is needed.

  5. Except in case of marginal weather or maintenance problems, a $20 late fee will be issued to the renter pilot if actual arrival time is past 30 minutes the scheduled arrival time. No fee will be charged on the first occurrence.

  6. Student pilots will not fly without the authorization and supervision of their instructor.

  7. Instructor scheduling will be conducted in the same manner as aircraft scheduling, Frequent cancellations and or no show customers can be charged for the Instructors time at their discretion.

 

3.0 Pilot Operations

  1. The renter pilot is responsible for submitting updated documentation for his file.

  2. Adequate flight planning and thorough aircraft preflight will be conducted.

  3. Pilots should verify that all the required documents and information is present in the aircraft.

  4. Pilot will notify CFA of any aircraft squawks. Please write detailed description on dispatch ticket.

 

4.0 Weather

  1. CL Finney Aviation, LLC weather minimums are:

    • Traffic pattern work at AAO or 1K1: 1,300 feet AGL (2,700 MSL) and 3 miles

    • East practice area: 1,500 AGL and 3 miles

    • Winds for student pilots:      15 knots total or 7 knots cross-wind

    • Winds for advance students: 25 knots total or 15 knots cross-wind (or personal minimums)

 

  1. Flights where temperatures are less than 15 F need prior approval from CL Finney Aviation, LLC.

  2. Flights to airports with ice on the runway must have braking action reported as good or better.

5.0 Cross Country Operations

  1. Flight operations shall be conducted on charted, hard surfaced airports only except as provided by 5.2.

  2. Flight operations on unimproved airports need prior approval from CL Finney Aviation, LLC.

  3. Flight operations will be conducted over the contiguous United States only.

  4. Operations at airports located on mountainous terrain will require a mountain checkout.

  5. If it is necessary for the renter pilot to cover the cost of fueling the aircraft the renter will receive credit for the expense at the current (AAO) purchase rate. A copy of the receipt should be submitted and will be deducted.

  6. CL Finney Aviation, LLC will not reimburse courtesy car fees, hangar fees or fees for items not specifically requested by CL Finney Aviation, LLC excluding fuel or engine oil.

 

6.0 Maintenance / Squawks

  1. In the event of mechanical problems, the pilot shall not tamper with the airplane or try to repair it. Contact CL Finney Aviation, LLC to authorize any maintenance. Authorized A&P mechanics are allowed to inspect and make necessary work to get aircraft to home base.

  2. Hand propping is not allowed on any CL Finney Aviation, LLC aircraft.

  3. All Squawks should be recorded on the aircraft dispatch sheet.

 

7.0 Aircraft Operation Procedures:

  1. Checklists in each aircraft shall be used at all times.

  2. All CL Finney Aviation, LLC aircraft should be leaned for idle and taxi when the surface temperature exceeds 50 degrees F.

  3. Pilots will observe proper control wheel position while taxing and keep speeds below 20 kts.

  4. Aircraft should be preheated for temperatures below 32F.

  5. After three unsuccessful attempts to start the engine, a flight instructor or aircraft mechanic must be consulted for assistance.

  6. Should a mag drop occur during the Before-Takeoff Checklist, the pilot should try the following procedure:

    • Throttle:      Max static rpm

    • Mixture:      Adjust to leanest mixture setting which will allow max static rpm for 20 seconds

    • Mags:         Re-check

    • Mixture:      Reset per normal procedure

  7. Weight and Balance, Performance and density altitude will be considered before each flight.

  8. Food and drink is allowed in aircraft as long as no trash is left in the aircraft..

  9. Pilots will lean mixture for cruise flight whenever the density altitude exceeds 5000’.

  10. The pilot is responsible for securing the aircraft after landing. This includes control locks, windows, doors, removal of trash, and aircraft tie down when needed.  The pilot will arrange to have the aircraft hangered when away from the home base over night.  These expenses will be the responsibility of the pilot.

 

9.0 Rental Checkout

  1. All private pilot checkouts must be done with a CL Finney Aviation, LLC instructor

  2. The customer must have a checkout once a year or at discretion of their instructor.

  3. If the customer should get stranded on a cross-country flight due to weather, then he or she shall be responsible for any and all aircraft and instructor costs that are accrued for the return of the aircraft back to aircraft home base

  4. Upon completion of the checkout, the customer may exercise all rights and privileges pertaining to a private pilot certificate in accordance with local, state, FAR/AIM, POH and CL Finney Aviation, LLC operating procedures.

  5. Failure to follow local, state, FAR/AIM, POH or CL Finney Aviation, LLC operating procedures may result in termination of rental privileges.

 

10. 0 Instrument Checkout

  1. All instrument checkouts must be done with a CL Finney Aviation, LLC instructor.

  2. The customer must remain current in accordance with 61.57C (1)

  3. A new instrument check out is required if the customer has not flown CL Finney Aviation, LLC aircraft in past 12 months.

 

 

 

 

Aircraft Rental Agreement

CL Finney Aviation, LLC DBA AirCap Aviation

                                                                        

 

CL Finney Aviation, LLC (CFA) hereby agrees to rent aircraft to (customer) subject to all the terms and conditions of this agreement, in consideration whereof, customer hereby acknowledges and agrees to all of the following:

 

  1. This agreement will be valid after customers signs statement of agreement and the following Information and documents have been submitted:

 

          *Copy of Pilot’s Certificate and Gov. photo ID

          *Copy of current Medical

          *Copy of last BFR endorsement (or equivalent)

2. Customer will be responsible for submitting updated documentation to maintain this agreement in effect.

3. The answer to the following questions is “no” or an explanation deemed satisfactory to CFA management has been                  provided in writing.

           *Have you ever been involved in any aircraft accident or incident or resulting in FAA

              enforcement?                                               

            *Have you ever had your Driver’s License suspended or revoked?

            *Have you ever been denied aircraft rental privileges?

            *Have you ever been convicted of operation a motor vehicle under the

              influence of any drug?                                              

4. I understand that this is a rental agreement only, and that CFA reserves the right to terminate it at any time at their own discretion.

5. CFA reserves the right to refuse aircraft rental during adverse weather conditions deemed unsafe by CFA personnel.

6. This agreement will expire one year after a CFA aircraft was last flown. An annual check-out flight with a CFA instructor is required of any renter pilot to verify proficiency.

7. The rented aircraft may not be used for any type of commercial flight operations.

8. I will not resell or sublease the use of this aircraft.

9. I have received information and understand the extent of the insurance provided by CFA, including my privileges and responsibilities. I also agree to pay all deductibles in the event of an accident while I am renting the aircraft.

10. When operating a CFA aircraft, customer is required to observe all State, County and Federal Aviation Regulations.

11. I have read, understood and agree to conform to all CFA operational procedures as described in the latest version of CL Finney Aviation, LLC Operating Procedures

12. I agree to hold CFA and their employees harmless from all claims for loss of damage to personal property of customer (or any person) left or carried in aircraft anytime before, during or after this rental. Customer further expressly agrees to, and hereby does, indemnify and hold CFA and their employees harmless from any liability to other persons, any costs of damages arising throughout the customer’s use of any CFA aircraft.

13. I understand that as the renter, I am the only pilot approved to operate the aircraft.

14. I have been advised by CFA personnel that additional renter insurance is encouraged to be purchased to cover any additional cost not covered in our present policy on CFA aircraft.

15. I consent to a criminal background check and FAA background check.
